Red Spade Pass Competition Terms and Conditions ("Special Terms")

The following Special Terms form the information for the Social Media Race ("Competition"). THIS COMPETITION IS VOID WHERE PROHIBITED.

  1. The promoter of the Competition is TSG Interactive Plc ("Promoter", “PokerStars” "we" or "us"), whose registered office is at Spinola Park, Level 2, Triq Mikiel Ang Borg, St Julians SPK 1000, Malta.
  2. By entering the Competition, participants ("Entrant(s)") a) agree to be bound by these Special Terms and the general terms and conditions for promotions ("General Terms") that apply to all promotions and competitions organised by the Promoter in connection with the www.pokerstars.ro website ("Site") and b) confirm that they meet all eligibility requirements for the Competition.
  3. The Competition is in no way sponsored, endorsed, or administered by, or associated with, Instagram or any other social network.
  4. The Competition is not in conjunction with or tied to any other competition or promotions that may be running at the same time or other times.
  5. There is no entry fee and no purchase is necessary to enter the Competition.
  6. Every Entrant is limited to one entry and any subsequent entries will be disqualified.

Who is eligible?

  1. Entrants must meet the eligibility requirements as specified in these Special Terms and the General Terms. Failure to meet the eligibility requirements may result in an entry being invalid and/or forfeiture of any prize.
  2. Entrants must be at least 18 years of age, resident in Romania and have a verified and validated account on the Site. Proof of identification, age and address may be required at the request of the Promoter and the Promoter reserves the right to conduct any ID and security checks it sees fit to confirm Entrants comply with all eligibility requirements.
  3. Entrants must not permit or allow another person to take part in the Competition on their behalf.
  4. Employees and relatives and/or affiliates of employees of (i) the Flutter Group and (ii) Influencer A and/or Influencer B (“the Influencers”), are not permitted to participate in any Promotion. For the purpose of this clause, the term 'relative' shall mean but not be limited to spouse, partner, parent, cousin, child or sibling and 'affiliates' shall include, but not be limited to, such an employee's housemate(s) or co-habitee(s).

How to qualify and how the Competition works

  1. In order to be eligible for the Competition, Entrants must:
  1. have a valid Instagram account which must not be set to “Private” (as we will not be able to see the entry) and must not be deactivated, suspended or otherwise prevent us from viewing the Competition entry prior to selection of the winner (as set out at paragraph 12 below);
  2. at the time of selection of the winner, follow the PokerStars Casino Romania Official Instagram account @PokerStarsCasino.RO (“PS Instagram Account”);
  3. between September 1, 2022 until 09:00 EET on September 10, 2022 “Entry Period”), share a qualifying Reel Remix on their Instagram account with the hashtag #RedSpadePass. To qualify, the Reel Remix must:
    1. be a Remix of a Pitstop Challenge Reel posted by PS Instagram Account and tagging either @cristinaa.stefaniaa (“Influencer A”) or @iamspeak (“Influencer B”); and
    2. show and feature content created by the Entrant where the showcase ability is less than 2 seconds in length.
  4. This is the only entry route to the Competition and entries that do not comply with the provisions of this section 11 will not be eligible.
  1. Following the end of the Entry Period, the Influencers will score the eligible entries. Influencer A will score all entries remixing Influencer A’s Pitstop Challenge Reel and Influencer B will score all entries remixing Influencer B’s Pitstop Challenge Reel. Scores out of 5 will be awarded for each of the following criteria: creativity, originality, quality of the video and compliance with the Pitstop Challenge theme of ‘what can you do in under 2 seconds’. The three entries awarded the highest overall scores by Influencer A will be entered into the “Race Period” as Team A, and the three entries awarded the highest overall scores by Influencer B will be entered into the “Race Period” as Team B. If there are any tied overall scores affecting selection of entries for the “Race Period”, the applicable qualifying entry will be randomly selected from the applicable entries with the same overall score.
  2. The six Reel Remixes qualifying for the “Race Period” will be downloaded by PokerStars and posted as native content on the PS Instagram Account on September 12, 2022. Instagram users will then be able to vote until 09:00 EET on September 15, 2022 (“Closing Time”) by liking the post on the PS Instagram Account containing their favourite Reel Remix. The Reel Remix from Team A with the most Instagram Likes at the Closing Time and the Reel Remix from Team B with the most Instagram Likes at the Closing Time will each win a prize. If more than one Reel Remix in either team shares the highest number of likes, the winner for that team will be randomly selected from the Reel Remixes sharing the same number of likes.
  3. Winners will be announced and tagged in a comment on the applicable post on the PS Instagram Account containing the winning Reel Remix (“Notification”).

The Prizes

  1. There are two Red Spade Pass experiences as prizes, one for the winner in Team A and one for the winner in Team B. Each prize consists of the following for the winner and one companion.
    • VIP viewing experience at the São Paulo Grand Prix on 11, 12 and 13 November 2022.
    • Return economy class flights from a Romanian airport to São Paulo, Brazil (outbound November 9-14, 2022]).
    • 5 nights’ accommodation Sheraton Sao Paulo WTC Hotel (2 people sharing) in a hotel in São Paulo (one room for winner and companion to share).
    • Transfers between the winner's arrival airport in São Paulo and the hotel.
    • Transfers between the hotel and the viewing experience on each day of the event.
  2. The winners’ companions must be aged 18 or over.
  3. Flights can only be arranged from Romania.
  4. The prize does not include any costs, taxes, fees, expenses and/or arrangements not expressly specified in the prize description. The winners and their companions are solely responsible for, and PokerStars will not be liable to reimburse the winners/their companions for, any such additional charges and expenses.
  5. The winners and their companions must make their travel arrangements through PokerStars’ designated agent and use the carriers and providers selected by PokerStars or its designated agent. Each winner and their companion must travel together and must follow the itinerary provided by PokerStars or its designated agent.
  6. It is the responsibility of the winners and their companions to check any requirements for the airline, hotel, event venue and any other supplier providing elements of the prize. The winners and their companions are bound by, and must comply with, any terms and conditions set out on their event and airline tickets and the rules, regulations, requirements and policies of the airline, hotel, event venue, event promoter and any other supplier connected with the prize. PokerStars is not responsible for any failure of the winners and/or their companions to gain entry or re-entry to the airline, hotel and/or event, or to participate in any element of the prize, due to any action/inaction on the part of the winners and/or their companions.
  7. It is the responsibility of the winners and their companions to check and ensure that they satisfy all customs, security and immigration requirements in relation to travel between Brazil and Romania (including all requirements relating to passports, visas and other documentation). PokerStars has no liability if the winners and/or their companions are refused entry because they do not satisfy such requirements and the winners/their companions are solely responsible for all costs associated with refused entry.
  8. It is the responsibility of the winners and their companions to check any government travel advisories relating to the travel destination and to determine what action to take in relation to any such advisories. PokerStars has no liability if the winners/their companions do not make such checks, if they choose to travel despite the advice given in any relevant advisory or if they choose not to travel on the advice given in any relevant advisory (in which case PokerStars will not be obliged to offer a substitute prize).
  9. It is the responsibility of the winners and their companions to check whether any vaccinations and/or prescription medicines are recommended or required prior to travel and PokerStars has no liability in this respect.
  10. It is the responsibility of the winners and their companions to take out their own travel insurance in connection with their prize. PokerStars will have no liability for any failure by the winners and/or their companions to take out travel insurance and/or to comply with the terms and conditions of their travel insurance policy.
  11. PokerStars has no liability for lost or stolen tickets, vouchers, certificates and/or other documentation connected with the prize.
  12. All elements of the prize are strictly non-transferable, non-exchangeable and may not be re-sold. No cash or any other alternative is available for any element of the prize. No alternative dates are available.
  13. If any element of the prize becomes unavailable, or if the winners are unable to use/take part in any element of the prize, for any reason beyond PokerStars’ reasonable control, PokerStars is not obliged to offer an alternative prize or any cash alternative or compensation.
  14. The winners and their companions must not do anything that may bring the PokerStars, any of its group companies or its commercial partners into disrepute. PokerStars reserves the right to take appropriate action (including the removal of any element of the prize) if the winners and/or their companions act in a way that PokerStars reasonably considers to bring the PokerStars, any of its group companies or its commercial partners into disrepute.
  15. PokerStars is not liable for any loss, theft, damage or injury caused or sustained by the winners/their companions as a result of participating in their prize (except that PokerStars will be liable for death or personal injury arising from PokerStars’ negligence or for fraudulent misrepresentation).
  16. Prizes may be replaced with a substitute prize of equal or greater value, if circumstances beyond PokerStars’ control make it necessary to do so.

Claiming your Prize

  1. To claim their Prize, each winner must send to the Promoter a private message via the PS Instagram Account within 72 hours after the Notification is posted.
  2. If the Promoter does not receive a private message from a winner within this timeframe, the relevant winner may forfeit their Prize. The Promoter may then select the Reel Remix with the next highest number of likes in the applicable team (or by random selection if there is more than one Reel Remix with the next highest number of likes) as a replacement winner (and this process may, at the Promoter’s discretion, be repeated until a winner able to accept the prize is found).

What else do Entrants need to know?

  1. The Promoter reserves the right to disqualify an Entrant and forfeit their prize where the Promoter has reasonable grounds to believe that: (i) there has been a breach of these Special Terms and/or the General Terms, (ii) an Entrant has gained unfair advantage in participating in the Competition, (iii) an Entrant has used fraudulent means in connection with the Competition. The Promoter will be the final arbiter in any decisions, which will be final and binding and no correspondence will be entered into in this respect.
  2. If the Promoter wishes to promote the Competition and the prize winners for PR purposes, it will seek the winners’ consent and the winners may be asked to provide a quote about the win, their name, their town/city of residence and a photograph for publication on the Site and the Promoter’s social channels.
  3. The Promoter, its group companies and its agencies and contractors, shall not be liable for any problems or technical malfunction of any computer on-line systems, servers or providers, computer equipment or software, failure of any entry to be received on account of technical problems or traffic congestion on the internet, Facebook or at any website, including any injury to or resulting from participation or downloading of any materials in the Competition.
  4. The Promoter reserves the right to amend, alter or terminate this Competition at any time without notice, including in the event of any actual or anticipated breach of any applicable law or regulation or in any other event outside of the Promoter’s control, and the Promoter shall have the right, at its sole discretion and at any time, to change or modify these Special Terms, and such change shall be effective immediately upon posting them on the Site.
  5. To the extent permitted by applicable laws, the Promoter does not accept any liability for any damage, loss, injury or disappointment suffered by any Entrant as a result of either participating in the Competition or not winning a prize.
  6. The information provided will only be used by the Promoter in connection with the Competition in accordance with the Privacy Policy available here.
  7. The Competition and these Special Terms shall be governed by Romanian law and any disputes shall be subject to the exclusive jurisdiction of the courts of Romania.
  8. The invalidity, illegality, or unenforceability of the whole or any part of the Special Terms does not affect or impede the continued validity, legality and enforceability of the remainder of the Special Terms.
